Facts:
Mr C Price, rider of JWALKE in race 2 at Otaki, The Riverstone Cafe Highweight, admitted a breach of Rule 638 (3)(b)(i) in that he struck his mount JWALKE over the final 200 metres which was unnecessary.
The relevant rule reads: A rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary.
Mr Price, after the rule was read confirmed he understood the rule and that he admitted the breach.
Mr Goodwin, using the available films took the Committee through the incident. He stressed strongly that the Steward's concern was the unnecessary use of the whip. JWALKE was well ahead at the 600 metres and travelling strongly. Upon straightening up Mr Price struck the horse a couple of times. The horse responded and increased its lead. At about the 200 metre mark the horse was struck again at least 5 times until just short of the winning post. The winning margin was 12 and a half lengths and Mr Goodwin reiterated that in the Steward's view the striking of JWALKE at about the 200 metre mark was unnecessary as the horse was well out in front and travelling much better than any others in the race.
Mr Price had no questions of Mr. Goodwin and informed the Committee that he had not been in the country long and this was his fifth ride and his first winning one. He understood the rule and the reasons for it but in the United Kingdom the rules state a horse can only be struck seven times during a race. He agreed the incident looked bad and was unnecessary. He had ridden the horse once before and had been told to ensure the horse kept its mind on the job. He had looked over his shoulder and did not realise his horse was increasing his lead.
Submissions for Penalty:
Mr Balcombe asked that in setting a penalty the Committee take into account Mr Price's admittance of the breach, his full cooperation with the Stewards and the fact that it was his first winning ride in New Zealand. Mr Balcombe believed that the winning of the race was never in doubt and the use of the whip from the 200 metres was totally unnecessary. He asked for a fine that was below the JCA guidelines for a first offence.
Mr Price had no comment.
Reasons for Penalty:
In coming to its decision to impose a fine for this breach the Committee took into account Mr Price's admittance and his full cooperation with the Stewards. The Committee was impressed with Mr Price's remorse over the incident and even though it was only his fifth ride in New Zealand his understanding and reasons for the whip rule. The Committee believed a discount from the suggested monetary guidelines should occur for this particular breach of the rule.
