Decision:

The Judicial Committee had careful regard to all the submissions. We could understand the reasons Mr Lennox put forward for not running HERMAN MUNSTER and while we had some sympathy for the situation he found himself in we declined his request to scratch the horse.

Facts:

The Judicial Committee was presented with an information for a Request for a Ruling. The detail of the ruling being sought was that “S Lennox has made an application to scratch HERMAN MUNSTER in Race 7.”

Rule 534 (2) (b) states;

If the Stipendiary Steward is not so satisfied, he shall complete an information and file it with the Registrar of the Judicial Committee and the Judicial Committee shall then determine whether there are such circumstances and whether the Owner or lessee (as the case may be) or his Agent or its Racing Manager is authorised to scratch the horse after that time.

(c) A material change in the condition of the track, occurring after the scratching deadline (as specified for the relevant Race Meeting in accordance with Rule 510(d) (v) or as amended by NZTR from time to time) on the relevant Race day, shall be deemed by the Stipendiary Steward and the Judicial Committee to constitute such circumstances.

Submissions for Decision:

Mr Lennox is the Licensed Trainer of the horse Herman Munster. He told the committee that his impression of the track conditions changed after arriving on course and noting the times run on Races 1 and 2. He said the conditions were much worse than he thought they would be and he did not want to risk his horse by running him on such a heavy track. This was to be the horse's first up run and he believed it would be detrimental to start him in such conditions.

Mr Neal said the track was rated a Heavy 11 prior to the scratching deadline and there had not been any material change since then. The scale does not extend beyond an 11 rating however if there had been further rain after the scratching time it was possible to have a material change (in the track conditions) whilst still officially being rated an 11 track. This however was not the case today.

Reasons for Decision:

We based our decision on the fact that there had been no material change in the track conditions since the deadline for scratching. There had been no sudden change in the weather and certainly no further rain which may have changed the track conditions from early morning. Unfortunately Mr Lennox had made an error of judgement in his assessment of the track and we found no special circumstances existed that gave him authority to scratch HERMAN MUNSTER.
