Decision:
Following the running of Race 1, The Kapiti Coast Steeplechase, Mr P Boylan was charged with careless riding under rule 871 (1) (d).
Following the running of Race 1, The Kapiti Coast Steeplechase, Mr P.Boylan was charged with careless riding under rule 871 (1) (d). The information alleged that inside the final 200m he allowed his mount to shift in and hamper Van Winkle.
--Mr Boylan admitted the breach.
--Although the incident had been viewed during the prior protest hearing Mr George replayed the video film and outlined the nature of the interference. He said that by laying in on Van Winkle Mr Boylan took away that horse's opportunity of racing in a straight line. Mr Boylan continued to ride with the whip even while his mount Fontera was moving inwards and hampering Van Winkle.
--Mr Ching said the stewards placed the degree of carelessness in the medium range but to also remember that there had been a relegation.
--His record showed one charge of careless riding incurred on the 16th August 2007 at Waverley and they submitted that a 3 ? 6 day suspension be considered.
--Mr Boylan told the committee that Fontera does have a tendency to lug inwards and once he realised that he was moving inwards he straightened the horse up. He said that he just wanted to make a name for himself as a jumps rider and as he had started late in the season he would prefer a fine.

Penalty
--In coming to a decision on penalty the committee considered all of the submissions put before it.
--Mr Boylan was given credit for admitting the breach however this was his second charge of careless riding in two days and Fontera had been relegated as a result of his carelessness. While acknowledging that he had straightened his mount he needed to take more immediate corrective action.
--Mr Boylen is suspended from riding from the conclusion of racing on Saturday August 25th until the conclusion of racing on Saturday September 1st.
