Accordingly, Mr Aukett’s license is suspended from the close of racing today Thursday April 15th, up to and including racing on Sunday April 25th, 2021. In addition, he is fined the sum of $250.
Facts:
Following the running of Race 3, (Aquashield Roofing Maiden), an Information was lodged by Mr Goodwin alleging a breach of Rule 638 (1) (d) in that R Aukett permitted his mount RODENT to shift inwards when not sufficiently clear of LITTLE TEXAS SKY (F Lazet) which was checked near 1000 metres.
Mr Goodwin had Mr Oatham demonstrate the incident by way of the video footage. Mr Aukett jumped from barrier no 9. Seeking a run closer to the rail he went forward and could be seen looking to his inside as he did so. If he had continued to go forward Mr Oatham said he would have cleared Ms Lazet’s mount, but he was only a bare length clear when he took her rightful line of running.
Mr Aukett told the Committee that RODENT was a big striding horse and he thought he was clear of Ms Lazet. He said he would have to take the consequences.
Submissions for Penalty:
Mr Goodwin said Mr Aukett’s record was clear of any careless riding charges, and he rarely caused any issues. The Stewards placed the incident in the mid-range and submitted a term of suspension was an appropriate penalty.
Mr Aukett said he took full responsibility for the breach and agreed that it was a midrange breach.
Reasons for Penalty:
The Committee considered all submissions. Mr Aukett is not an inexperienced Rider but had 7 years in Perth away from racing. He returned to Otaki where he has been riding work.
Today’s breach was simply an error of judgement. If Mr Aukett had allowed his mount to stride forward, instead of easing, there would have been no check to Ms Lazet’s mount, but unfortunately, she lost ground and momentum as a result.
The Committee adopted a starting point of 5 days suspension and a $500 fine. A one-day discount and a reduction in monetary penalty was afforded for Mr Aukett’s good record and ready admission of the breach.
Balancing up all factors an appropriate penalty is one of 4 days suspension, and a fine of $250.
