We have decided a period of suspension is appropriate. Mr Ward is suspended for 3 riding days from the close of racing on Saturday 16 April 2011 to the close of racing on Saturday 23 April 2011 – the 3 riding days being Te Aroha (20 April), Feilding (21 April) and Hawkes Bay (23 April).
Charge:
Following the running of race 9, information 5380 was filed by Stipendiary Steward Mr N Goodwin under rule 638 (1) (d). The information stated that “N Gow permitted his mount MADANSKE to shift in near the 1400m when not clear of PYCOCK FLYER (M Ward) which was checked”.
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”
Mr Gow indicated the breach of the rule was admitted and also that he understood the charge and the rule it was laid under.
Facts:
Mr Goodwin used the head-on view of the film to identify Mr Gow who had started from barrier 10 in the 14 horse field. He said that near the 1400m point, some 200m after the start, Mr Gow commenced moving inwards in an attempt to get closer to the running rail and in doing so caused a check to “Madanske” ridden by M Ward. He said Mr Ward was forced to check off the heels of “Madanske” and in doing so lost ground. Mr Goodwin then showed a side on view of the incident taken from the back straight.
Neither Mr Gow or Mrs Zimmerman had any comments to make when invited to do so.
Submissions for Penalty:
Mr Goodwin said Mr Gow was a relatively inexperienced apprentice jockey who had had approximately 40 rides in his short career. This was his first charge of any kind. He said whilst the check received by Mr Ward was not severe and he did not clip heels he nevertheless did lose ground when forced to check off the heels of Madanske. He rated the interference in the mid-range. He confirmed Mr Gow could be treated as a national rider as he had previously ridden on the West Coast of the South Island. He submitted a period of suspension would be an appropriate penalty.
Mrs Zimmerman said that Mr Gow had a confirmed engagement for Trentham on Saturday 16 April and that if he were to be suspended that it commence after that meeting.
Reasons for Penalty:
As the breach of the rule was admitted the charge was found to be proved. The Committee has reviewed the films of the incident referred to and listened to all the submissions made. We have also noted that the check received by Mr Ward was not a severe one although enough to cause his mount to lose ground in the incident. We believe the interference is in the mid range and have taken into consideration Mr Gow’s admission of the breach of the rule and that this is his first charge under this or any other rule in his short riding career.
