The committee ruled that SAVARHYS be declared a runner.

Facts:

Following the running of Race 8 (RACHAEL FROST RACING HANDICAP) Information No. A2725 was filed with the Judicial Committee requesting a ruling. The Information alleged that SAVARHYS was denied a fair start by being held by an Attendant when the start was effected.

Rule 632 reads:

If in the opinion of the Judicial Committee, a horse which does not finish in the first 3 placings was prevented from taking an effective part in a race owing to the mechanical failure of the starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such a horse to be a non-starter.

Submissions for Decision:

The films were shown and Mr Lammas said that just prior to the start being made his horse reared up and that he was dislodged. He said that the Attendant was doing his best to keep the horse settled and that it was not his fault that the horse reared up. He added that the horse reared and took no part in the race of its own accord.

Mr Phillips, the starter, agreed with Mr Lammas’ comments and added that when the horse reared up it was too late for him to take any action.

Ms Haworth did not have anything to say on the matter.

Reasons for Decision:

After considering the submissions and viewing the start of the race several times on video replay, the committee was satisfied that the Attendant was not responsible for SAVARHYS’ actions. The committee deemed that SAVARHYS reared just prior to the start being made and in doing so took no part in the race of its own accord.
