Facts:
Mr Davidson, stipendiary steward, alleged that Mr Moir, the rider of the 2nd horse QUARTZE in race 3, the Otago Hunt Steeplechase, weighed in more than 1 kg under the weight that he weighed out at.

Rule 648(3) states:
“If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.”
Submissions for Decision:
Mr Davidson stated that Mr Moir weighed out at 68 kg. He had viewed the written record to that effect prepared by Mr Mills, the weighing steward. He said on weighing back in Mr Moir was unable to make 67. He was 66.8 to 66.9 kg. Two stewards had witnessed Mr Moir endeavouring to make the weight but he had been unable to do so.
Mr Moir confirmed he had weighed out at 68 kg and that he was unable to make 67 when he weighed back in. He could offer no explanation for the discrepancy.
Mr Cameron, trainer of QUARTZE was also unable to explain the difference in weights and confirmed that he had placed the gear as given to him by Mr Moir on to the horse.
Reasons for Decision:
The rule is clear the horse must be disqualified where the jockey is unable to make the weight, despite the margin of 0.5 kg. (Sub-rule (4) has no application in this case.) Mr Moir has not been able to make the weight. He is 1.1 kg under.
