As Mr Mudhoo admitted the breach, it is found to be proved.

Penalty:

Mr Mudhoo is suspended from the end of the Invercargill meeting on 12 December up to and including 20 December. This is 2 South Island days.

Facts:

Mr Davidson alleged that in race 2, the Professional Event Maiden, Mr Mudhoo was careless in that he allowed his mount TYCOON CLASS to shift in crowding and checking DREAM DIVINE (R Black) passing the 1100 metres.

Mr Allison, Stipendiary Steward, demonstrated on the videos that the respondent was 3 wide in the back straight at the rear of the field. Mr Mudhoo shifted in to a 2 wide position to obtain cover and, in so doing, he came into contact with Ms Black who was also riding at the rear of the field and who had already moved from a 3 wide to a 2 wide position. Mr Mudhoo was not his length and another clear when he made this move.

Mr Harnett stated Mr Mudhoo’s horse was pulling when he was 3 wide and he had thought he could get back in 2 wide. He emphasised there was space there for Mr Mudhoo when he first saw it and Ms Black had pushed up, unbeknown to Mr Mudhoo.

Mr Mudhoo stated the first time he realised Ms Black was there was when she called out and he had relieved the pressure on her immediately. Mr Harnett pointed out there was no horse to the inside of Ms Black. It was not severe interference, but rather a bump. Ms Black had ended up back where she was prior to the incident.

Submissions for Penalty:

Mr Davidson produced the respondent’s record, which was clear under this rule. Mr Davidson described Mr Mudhoo’s record as very good. This was the respondent’s 25 ride and he was starting to ride more regularly. He believed the breach was mid to low end.

Mr Harnett emphasised Mr Mudhoo’s inexperience and his good record. He reiterated not too much damage was done by the respondent’s error.

Reasons for Penalty:

The Committee agrees with Mr Davidson that the breach is correctly described as being towards the lower end of the range. Mr Mudhoo has relieved the pressure on Ms Black immediately he realised she was there.

Mr Mudhoo is an inexperienced South Island apprentice and this is his first breach of any rule. Mr Harnett has said he will learn from this experience of being “in the room”. These are mitigating factors, as is his ready admission of the breach.

These factors merit a one-day reduction in the 3 day starting point.
