The Protest is dismissed. All placings called by the judge stand.

Facts:

Following the running of race # 2, the NZB Insurance Pearl Series 2-Y-O Bonus Race 1100, Mr M Pitman lodged a protest against the first placed horse Belle Miraaj alleging interference to So Vital rounding the home turn.

Protest rule 642 (1) reads: If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse after the horse interfered with.

The official margin between 1st and 2nd placings was ½ a length.

Submissions for Decision:

Mr Zarb, with assistance of the video replays, stated that as the field approached the point of the turn into the final home straight, Belle Miraaj, ridden by Mr Bradley, improved between the runners Princess Brook (inner) and So Vital (outer). On the point of the turn Belle Miraaj shifted out slightly coming into contact with So Vital causing a check to that runner.

Ms Morgan stated that the interference by Belle Miraaj caused her mount to lose its back legs. This in turn caused her horse to lose its momentum in the home straight. She believed the check had cost her three lengths. Her mount was finishing better than Belle Miraaj and was able to sprint home at the finish. Mr Pitman stated the interference caused by Belle Miraaj forced his horse to change stride. He was in no doubt his horse his horse would have beaten Belle Miraaj.

Mr Bradley stated he had improved across the top bend and was able to position his horse between So Vital and Princess Brook prior to the home straight. He said Ms Morgan had chosen a wider line and he had improved into the gap. He said both horses were travelling well on the bend. However, as the field straightened Princess Brook (C Johnson) rolled outwards about a half horse width coming into contact with his mount. This caused his mount to shift ground slightly coming into contact with So Vital. At no point was his mount the sole cause of the interference.

In summing up Mr Zarb stated he agreed with the evidence of Mr Bradley that the interference to So Vital was the result of Princess Brook coming into contact with Belle Miraaj and resulting in interference to So Vital. He did not believe So Vital had lost the two to three lengths in the home straight as stated by Ms Morgan.

Reasons for Decision:

It is clear that from the video replays of the incident and the evidence of Mr Bradley and Mr Zarb, that Belle Miraaj was shifted sideways onto So Vital by the outwards movement of Princess Brook. There is no evidence to suggest that the interference to Belle Miraaj was due to the racing manners of Belle Miraaj or the riding of Mr Bradley.
