Mr Mudhoo admitted the breach and it is found proved.

Penalty:

Mr Mudhoo asked for a deferment which takes the starting point for a suspension from November 12th. We suspend Mr Mudhoo’s licence from the 12th November up to and including the 17th November (5 days).

Facts:

Following the running of the Otago Tyres 1400, Stewards lodged an Information alleging Mr K Mudhoo rode carelessly when he ”…permitted his mount (Jakaya) to shift inwards near the 100m mark and tighten "Jandles" (S Muniandy) which had to steady.”

Mr Mudhoo appeared at the hearing assisted by co-trainer Mrs K Parson. He understood the nature of the charge and admitted the breach.

Mr McLachlan showed the video and highlighted the incident. He said both "Jakaya" and "Jandles" were racing near the rear of the field in the home straight. About 200m from the finish "Jakaya", which was racing wider out, shifted inwards when struck with the whip on several occasions. Approaching the 100m mark Mr Mudhoo allowed his mount to shift inwards further when taking a gap. But, in doing so he shifted inwards onto "Jandles" causing Mr Muniandy to take a hold and check his mount. Neither horse finished in a stake bearing position.

Mr Mudhoo stated "Jakaya" was racing greenly and shifted inwards when struck with the stick. When he went for the gap he was shaking the stick at his mount and she ducked inwards onto "Jandles".

Mrs Parsons stated "Jakaya" was having its first raceday start and that "Jakaya" went for the gap when it became available.

Submissions for Penalty:

Mr Davidson stated Mr Mudhoo had an excellent record for an apprentice jockey. He had 286 rides last season and nearly 50 rides so far this season. He had two previous suspensions in January and March this year. He averaged about 3 to 4 rides per meeting. He placed the incident at the low end of the scale and was seeking a suspension of 6 days.

Mr Mudhoo accepted the submissions of the Stewards but did ask for a deferment to allow him to ride at Riccarton on the 11th November where he had confirmed rides.

Reasons for Penalty:

Mr Mudhoo admitted a breach of careless riding. We accept the submissions of the Stewards that the level of carelessness was at the low end. Neither "Jakaya" nor "Jandles" were in a challenging position when the incident took place. We take a starting point of a six day suspension. We give Mr Mudhoo credit for his excellent record and also take into account that "Jakaya" was having its first raceday start and was racing greenly.
