Decision:

Mr Davidson alleged that Mr Todd was guilty of careless riding in that he allowed his mount ELUSIVE STAR to shift ground inwards when not clear causing crowding to METROPOLITAN and STARRING near the 1000 metres.

Mr Ching demonstrated the incident on the video, which showed Ms Spittles being crowded and Mr Lammas being buffeted and then having to check off Mr Todd’s heels.  He said Mr Todd had looked twice but still came across when not clear. Mr Todd admitted the breach. We thus find the charge of careless riding proved.

Mr Todd acknowledged he heard yelling but thought that it related to Mr Bullard who he was following across.  He said, as a consequence he did not pull back and continued to press forward, in the belief that he was clear. The result was that Mr Todd moved inwards crowding Ms Spittles and causing Mr Lammas to have to check out.

Mr Davidson has described the breach as mid range and has asked for a 5 to 6 day suspension.  We agree it is mid range.  Two horses were checked as a consequence of Mr Todd’s inwards movement when not his length and another length clear.

Taking into account this is a listed stakes race, we take a starting point of 5 to 6 days, and give credit for Mr Todd’s open and frank admission of the breach and his fairly good record for a very busy rider of 2 previous breaches of this Rule this season, with the last being almost 6 months ago.  We accept, as does Mr Davidson, that Mr Todd has commitments to ride a number of horses at Trentham next Saturday and we agree to Mr Todd’s request for a deferment. He is suspended from riding at the end of racing on Saturday 14 March up to and including 20 March 2009. This is 4 riding days.
