Decision: Mr Davidson alleged that Mr Yusof was guilty of careless riding in that he allowed his mount BENT to shift ground inwards when not clear causing a check to MS KEEPER (Mr Bothamley) near the 600 metres.
Mr Davidson alleged that Mr Yusof was guilty of careless riding in that he allowed his mount BENT to shift ground inwards when not clear causing a check to MS KEEPER (Mr Bothamley) near the 600 metres. Mr Yusof admitted the breach. We thus find the charge of careless riding proved.

Mr Davidson had Mr Ching, stipendiary steward, demonstrate the incident on the videos. He showed Mr Yusof moved from one off the rail to the rail and, in so doing, Mr Yusof caused a check to Mr Bothamley. He was not his length and another clear at this time. Mr Yusof said he looked and he thought he was clear. He said he was “green and inexperienced” and asked us to take this into account.

The circumstances of this breach are remarkably similar to the previous incident in race 6, as the parties have acknowledged. Again Mr Yusof was not his length and another clear when he moved to the rail and Mr Bothamley has had to check out.

Mr Davidson has emphasised that it was a listed stakes race. He has described the breach as mid range. Again we agree. He has asked for a 5 to 6 day suspension. Again we give credit for Mr Yusof’s admission of the breach and his very good record, but this must be tempered by his previous breach in similar circumstances in the previous race. We also take into account that this is a listed stakes race. We take a starting point of 7 days and reduce it to 6 days for the mitigating factors. Mr Davidson has asked that we exclude central district meetings from our calculations. We do not do this as Mr Yusof is a North Island based rider. However, we exclude Invercargill from our calculations as Mr Yusof has indicated that he was not intending to ride there. We include all other meetings in our calculations. Mr Yusof is suspended from riding after 13 March up to and including 25 March 2009. This is 6 riding days.
