Decision: Mr Davidson alleged that Mr Yusof was guilty of careless riding in that he allowed his mount GROOVE ARMADA to shift ground inwards when not clear causing a check to URANGMAN near the 500 metres.
Mr Davidson alleged that Mr Yusof was guilty of careless riding in that he allowed his mount GROOVE ARMADA to shift ground inwards when not clear causing a check to URANGMAN near the 500 metres. Mr Yusof admitted the breach. We thus find the charge of careless riding proved.

Mr Davidson had Mr Ching, stipendiary steward, demonstrate the incident on the videos. He showed Mr Yusof moved from one off the rail to the rail and, in so doing, Mr Yusof caused a check to Ms Mundy. Mr Holmes, on Mr Yusof’s behalf, said Ms Mundy’s mount was tiring and this made the incident look worse than it actually was. We accept Mr Holmes’s statement that Ms Mundy’s mount was tiring but nonetheless she was entitled to her line of running.

Mr Davidson has described the breach as mid range and has asked for a 4 day suspension. We agree it is mid range.

We take a starting point of 5 days and give credit for Mr Yusof’s admission of the breach and his very good record of no breaches this season. We note Mr Yusof has had some 90 rides and has ridden 7 winners in this time. He is suspended from riding at the end of racing today up to and including 13 March 2009. This is 3 riding days.
