As Mr Bholah has admitted the breach, it is found to be proved.

Facts:
Mr Davidson alleged that Mr Bholah permitted his mount ROC LEONE to shift inwards passing the 1200 metres in race 8, the OTAGO FARM MACHINERY RATING 65, causing YES YOU DID (Mr Lowry) to check.
Mr McLaughlin, Stipendiary Steward, demonstrated on the videos that not long after the start Mr Lowry was established in a one-off position. Mr Bholah came across from gate 5 and kept coming and, in so doing, checked Mr Lowry.
Mr Walsh stated that the matter was clear cut. Mr Bholah had thought he was clear, but he was not.
Mr Bholah had said there was yelling but thought that was simply the jockeys wanting to take up their positions in the field.
Mr Walsh said the racing had been very tight at this point and Mr Bholah had not given Mr Lowry enough room and Mr Lowry had had to ease out.
Mr Bholah said he saw a gap and went to take it. He thought he was clear. He agreed with the submissions that Mr Walsh had made on his behalf.
Mr Davidson replied that Mr Bholah was only one length clear and not the required two. When Mr Bholah started to come across Mr Lowry was only ½ a length behind him.

Mr Davidson produced the respondent’s record which he described as very good. Mr Bholah had only had 22 rides and his win in race 9 was his second winner in this country. He had never previously been charged under this rule.
Mr Davidson described the breach as low range. He said Mr Bholah was never clear.
Mr Walsh stated that the breach was low-range. Mr Bholah had had limited opportunities and was doing well. He had made an error.
Mr Bholah said because he had so few rides, he was perhaps trying too hard to ride winners in order to get more rides. He always tried his best and was sorry he had interfered with Mr Lowry.
Reasons for Penalty:
The Committee believes the breach is low-range. Mr Bholah came across to take a position near the rail when he was not clear. Mr Lowry has had to ease his mount as a consequence. The starting point is 6 national days. This is Mr Bholah’s first breach of any rule. His record is thus very good. Two day’s credit is appropriate for this and his admission of the breach.
