Mr Pitman, trainer of BALZANE, lodged a protest against the 2nd placing of CITI DE LAGO on the grounds of interference to BALZANE at the start.

Mr Pitman, trainer of BALZANE, lodged a protest against the 2nd placing of CITI DE LAGO on the grounds of interference to BALZANE at the start. The relevant rule is 876(1). The margin between 2nd and 3rd was a 1/2 head.

Mr Pitman demonstrated on the video angles that immediately after the start CITI DE LAGO jumped inwards and in so doing took the line of BALZANE. He emphasised that CITI DE LAGO was not a length and another length clear when it came across and that he had instructed Ms Mundy the rider of BALZANE to take the horse to the lead. He said CITI DE LAGO’s movement had resulted in BALZANE having to check and lose at least a length.

Mr Bullard, rider of AETHERIUS, gave evidence that immediately after the start he was cannoned into by BALZANE as that horse was forced onto his mount and then to check as a consequence of CITI DE LAGO taking BALZANE’s line. He commented that the video angles were not good, and that the degree of interference was worse than it appeared on film.

Ms Mundy stated that she had received instructions to go to the lead "at all costs". She said that as she jumped CITI DE LAGO had come across quite sharply and she had been tightened as a result. She said the movement was sudden and she did not have time to yell out. She said as she restrained her horse she cannoned into AETHERIUS (Mr Bullard). As a consequence of Mr Todd’s mount crossing in front of her, she had to check and move to the outside of the field. She then raced 3 wide for the entire race.

Mr Ramsay, representing Mr Walker, agreed CITI DE LAGO had jumped inwards immediately after the start. He said, however, that BALZANE was slow to begin and that Ms Mundy was hitting her mount by the second stride. He said that because BALZANE was slow away it had not lost a length through the incident.

Mr Todd, the rider of CITI DE LAGO told the Committee that the horse jumped best and was 1/2 a length clear. However, he said it had jumped on an angle and he clipped his knee on the gates as a consequence. He said his horse was green and had not started at a race meeting before. He also said that it all happened "so quick" and before he knew it he was on the fence. He told the Committee that the fact that his mount and the horse on his outer had jumped out quicker than the other 2 horses in the field, had had a bearing on what happened.

Mr Ching when given the opportunity to comment stated that CITI DE LAGO clearly took the line of BALZANE. He said this was as the horses jumped. The issue he believed was not whether there was interference but whether it was sufficient to have cost BALZANE the race. In this respect he emphasised it was an 800 metres sprint and that the margin was only ½ a head.

The interference occurred at the start of the race and within the first stride of leaving the starting gates. Mr Bullard was very forthright in his evidence. He said he was cannoned into by BALZANE as that horse was forced to check as a consequence of CITI DE LAGO taking BALZANE’s line. He commented that the video angle was not good, and that the degree of interference was in fact worse than it appeared on film. He pointed out CITI DE LAGO had run directly to the fence.

While we do not have the benefit of a head-on film, we are satisfied from viewing the videos and hearing the oral evidence that BALZANE did receive interference immediately after the start. The cause of this interference was CITI DE LAGO jumping awkwardly and immediately running towards the rail. Ms Mundy on BALZANE was forced to steady and take hold of her horse and BALZANE also came into contact with AETHERIUS.

The Committee agrees that Ms Mundy’s racing line was taken by Mr Todd’s mount. We accept that CITI DE LAGO is only a 2 year old and was racing greenly. Indeed it was its first raceday start. Nonetheless, the horse moved across when not a length clear of BALZANE taking the racing line to which Ms Mundy was entitled. The distance that Mr Todd’s mount moved to race on the fence was greater than simply moving from gate 3 as gates 1 and 2 were not occupied and he came from gate 5 to end up on the fence. We agree that BALZANE, although slow away, has lost at least ½ L as a consequence of the interference. We have regard to the fact that the incident occurred at the start of the race, but note that it was only an 800 metre sprint and that BALZANE as a consequence of the interference ended up racing 3 wide for the majority of the race. We believe the interference has cost BALZANE the chance of a better placing. The margin between 2nd and 3rd was ½ a head.

We exercise our discretion and uphold the protest. The amended placings are 2, 5, 3, and 1.
