Mr Balloo admitted the charge and it is found proved.

Penalty:

Mr Balloo’s request for an 8 day deferment is granted and his Class A jockey’s licence is suspended from the end of racing on the 13th March up to and including the 21st March (6 National days) and is fined $350.

Facts:

Mr A Balloo was charged with careless riding following Race 10. Stewards alleged that Mr Balloo permitted his mount Our Echo to shift inwards near the 1400 metres when insufficiently clear of Cabernet, which was checked, and was in breach of r 638 (1) (d). Mr Balloo admitted the breach and appeared at the hearing.

Mr McIntyre, with the aid of the video replays, stated Mr Balloo was seen to shift inwards from a wide barrier draw and crowd Cabernet (C Campbell). He was barely a length clear when the crowding occurred and as a result Mr Campbell was forced to check his mount and lose his position. Mr Davidson stated that Cabernet raced erratically from that point and was retired from the event. Mr Campbell informed the Stewards that he did not think Mr Balloo’s actions were totally responsible for Cabernet being pulled up.

Mr Balloo stated he misjudged the distance between his runner and Cabernet when he crossed over. He heard some yelling from his inside but it was too late.

Mr Davidson said Mr Balloo had one previous careless riding charge in over 12 months of riding. That was in January when he received a 4 days suspension and a $350 fine. He said he had a very good record and was a busy Canterbury jockey. Stewards viewed the breach as mid-range and were seeking a 5 days suspension and a $250 fine.

Mr Balloo sought an 8 day deferment to allow him to ride at Ellerslie on the 13th March.

Reasons for Penalty:

Mr Balloo has a very good record with one previous charge of careless riding in January this year. We view this incident as mid to high range and the suspension and fine reflect that.
