As Ms Williams has admitted the breach, it is found to be proved.
Penalty:
Ms Williams does not seek any deferment of her suspension. She is suspended from riding from the end of racing today up to and including 17 February. She is also fined the sum of $500.
Facts:
Mr Davidson alleged that Ms Williams rode carelessly in Race 4 in that she permitted her mount SOOO DUSTY to shift inwards when not sufficiently clear of THE GIFT which was checked near the 1000 metres.
Mr Oatham demonstrated on the videos that the Respondent had drawn the outside barrier stall. Shortly after the start she commenced a run towards the rail. In so doing she crowded Mr Asano who was in restricted room for some time. Ms Williams then shifted out near the 1000 metres for a few strides before shifting back in. Mr Asano was again crowded, and he received a check as a consequence. The side-on view evidenced that Ms Williams was only 1/2 a length clear at this time. Mr Oatham added the comment that a number of horses were over-racing as the pace was quite slow in the early stages.
Ms Williams said as the pace eased, she had tried to slot in. She had stepped out to avoid another runner and had then come back in. She was not aware Mr Asano was there when she did so. When questioned, she said she was not sure if there was contact with his mount. She heard talking but it was not clear to her to whom it was directed.
Submissions for Penalty:
Mr Davidson produced the Respondent’s record which is clear under this Rule for the past 12 months. He described Ms Williams as a senior South Island rider with a very good record. This was a Listed Race and the Stewards viewed the breach as above mid-range. He believed a five to six-day starting point was appropriate. Mr Asano had been forced to race in tight quarters and the pace of the race had not helped.
Ms Williams did not disagree with Mr Davidson’s comments.
Reasons for Penalty:
Ms Williams has admitted a breach which we assess as being just above mid-range in a Listed Race. She has put Mr Asano in some difficulty near the 1000 metres by shifting in when not her length and another clear. He has had to check his mount as a consequence, as did Mr Chowdhoory (TAVILIGHT). We take a six-day starting point, which is one day above the mid-range guideline in the NZTR Revised Penalty Guidelines.
Ms Williams is an experienced South Island rider with an excellent record. She has admitted the breach. A one-day reduction is appropriate from the six-day starting point. The Guide also recommends a $500 fine for a mid-range breach.
