Facts:
Mr McIntyre alleged that Ms Black failed to make the carded weight for PETER RABBIT in race 8, the WHITE ROBE LODGE HCP IN MEMORY OF STEVEN ANDERTON.
Ms Black indicated on the information that she admitted the breach and did not wish to be present.
Rule 330(3)(c) provides:
(3) A Rider shall not: …
(c) fail to ride a horse at the weight at which it is handicapped to carry….
Mr McIntyre explained that the respondent was unable to make the weight for PETER RABBIT in race 8 despite her spending quite some time during the raceday in the sauna. She had approached the stipendiary stewards some 2 races before the race in question and had said she was unable to make the weight for the horse.
Submissions for Penalty:
Mr McIntyre submitted a fine of $150 was appropriate having regard to the status of the race and Ms Black’s good record.
Reasons for Penalty:
This is Ms Black’s first breach of this rule and we note she made a concerted although ultimately unsuccessful effort on the day to lose weight. We understand that an appropriate replacement apprentice jockey (Mr D Prastiyou) was found without difficulty. We note also that race 8 was an Open Handicap with a total stake of $70,000.
