Mr Hannam admitted a breach of rule 638(1)(d) in race 5 in that he allowed his mount SHUTTLEWORTH to shift in near the 1000 metres when not clear of THE BEEKEEPER (J Collett) who had to check. We thus find the charge proved.
--As Mr Hannam states, he only moved in for a stride but it is evident he was not the required distance clear and he caused a check to THE BEEKEEPER. We accept his statement that Mr Collett was not wanting to ride closer but that fails to take into account the fact that Mr Collett was entitled to his racing line.
--Mr Oatham described the breach as at the lower end and we agree. The level of interference was not high and the breach had no apparent bearing on the outcome of the race.
--Mr Hannam’s record is excellent up until last week when he was suspended for 4 days. Mr Oatham asks for 4 to 5 days. Mr Hannam asks for 3 days plus a fine in order that he can ride at Taranaki. Taking into account that this is a listed race and that Mr Hannam has a very recent breach of this rule, we find we are unable to accede to his request for 3 days and a fine. However, we believe 4 days adequately reflects the gravity of the breach, his ready admission of it, and his otherwise excellent record. We suspend Mr Hannam from the end of racing on 14 February up to and including 20 February.
