Mr Robinson admitted a breach of rule 638(1)(d) in race 3 in that he allowed his mount ACE OF DIAMONDS to shift out when not sufficiently clear causing BRING IT ON to check near the 300 metres.

Mr Robinson admitted a breach of rule 638(1)(d) in race 3 in that he allowed his mount ACE OF DIAMONDS to shift out when not sufficiently clear causing BRING IT ON to check near the 300 metres. We thus find the charge proved.
--We have viewed the videos of the incident and agree with Mr Oatham’s assessment of it as being low mid range. Mr Muniandy, who was riding causing BRING IT ON, was inconvenienced, although we accept Mr Robinson’s statement that BRING IT ON was weakening out. Mr Robinson’s mount ACE OF DIAMONDS was going well, as he says, and he was behind Mr Moseley whose mount was weakening, but this does not give him the right to move wider on the track into the line of another horse when not sufficiently clear. We accept that ACE OF DIAMONDS was wanting to surge forward and that Mr Robinson was finding himself in cramped quarters.
--We are concerned as to Mr Robinson’s record but this is balanced on this occasion by the fact that the breach is towards the lower end of the scale. We also give credit for Mr Robinson’s ready admission of the breach.
--Mr Oatham asks for 2 weeks and Mr Robinson does not disagree with this. He indicates that he has 2 probable rides at Manawatu on the 13th. He is suspended from the end of racing today up to and including Friday 19 February. This will permit him to ride at Invercargill on Gold Cup day.
