The protest is dismissed. The official placings stand. Stakes and dividends are to be paid accordingly.

Facts:

Following the running of race 2 the connections of JOHNNY JONES lodged a protest under Rule 642(1) against MULBERRY alleging interference approximately 100m from the finish.

The official placings were:

1st: LETSAVAFLING (3)
2ND: MULBERRY (4)
3RD: JOHNNY JONES (1)

The official margin between 2nd and 3rd was a long neck.

Mr Ydgren pointed out the relevant runners on the video replays.

Submissions for Decision:

Mr Mudhoo stated that after he angled JOHNNY JONES outwards for a clear run MULBERRY shifted inwards forcing his horse onto the rump of the leading runner about 100m from the finish. He was jostled for about 4 strides and his horse lost momentum briefly before finishing on in the straight.

Mr Collis said at the point of contact JOHNNY JONES suffered quite bad jostling for about four strides. He was a big horse and lost momentum, but in his view would have finished in second placing with a clear run as it was picking up ground the whole way.

Mr Cuneen stated MULBERRY was racing greenly in the home straight and stepped in briefly. He said his horse did brush JOHNNY JONES slightly and he had corrected his horse straight away. He believed his horse was “holding its own” and had JOHNNY JONES covered over the final 50m.

Mr Ridley stated both horses had shifted inwards at the same time. He said Mr Mudhoo would have had to straighten his horse anyway and was under pressure at that point also.

Mr Davidson stated that JOHNNY JONES was in restricted room for about three strides and although Mr Mudhoo was unable to use his whip, he had continued to push his horse out.

Reasons for Decision:

It is clear from the videos that both MULBERRY and JOHNNY JONES shifted ground inwards about the same time and that there was jostling for several strides. There was brushing between both runners and JOHNNY JONES came into contact with a forward runner losing momentum briefly. Mr Mudhoo continued to ride his horse out, although he was unable to use his whip for three strides.

The committee has to be satisfied that the interference is severe enough to warrant a change of placings. At the time contact was made MULBERRY had come from behind JOHNNY JONES and had a slight advantage over that horse. Significantly, over the final 50m JOHNNY JONES did not take ground off MULBERRY, indeed that horse could be seen to be drawing away from JOHNNY JONES. MULBERRY was a long neck clear of JOHNNY JONES at the finish line.

We are not of the opinion that JOHNNY JONES would have finished ahead of MULBERRY had the interference not occurred.
