Having regard also to your ready admission of the breach we impose a fine of $300 and strongly remind you of your obligations under the rules with respect to weight. We would anticipate any breach in the near future is likely to result in suspension.

Mr Lammas was charged with failing to make the weight for MENALEUS in race 8 and was replaced.
Facts:
Mr Lammas was unable to ride MENALEUS in race 8 at its carded weight nor indeed at 0.5 over.

Mr George submitted that a fine of $300 was appropriate.
Mr Lammas did not disagree with this submission.
Reasons for Penalty:
Mr Lammas, this is your 3rd breach of this rule in the space of 6 weeks, and this is of some concern to this Committee. We note you were fined $100 and $200 on these 2 previous occasions.
Mr George has submitted that a fine of $300 is appropriate, which we view as being at the lower end of the range given the recent nature of your transgressions. However, a significant mitigating factor is that you approached the stipendiary stewards and said you believed you would not do the horse any favours by riding it after wasting and while feeling faint.
We accept a senior apprentice has replaced you and the horse is unlikely to be significantly disadvantaged. However, those members of the betting public who invested on the horse believing you were riding it, have been misled.
