Decision: Under Rule 871 (1) (d) Mr Todd admitted a charge of careless riding in that he allowed his mount VICTORY MORGAN to shift inwards when not clear forcing KING OF JACKS in on to CAPE HORN who had to check near the 1000 metres.

Mr Ching had Mr Davidson, stipendiary steward, demonstrate on the videos that in the back straight Mr Todd and Mr Johnson had improved their mounts swiftly whilst the pace was very slow. Mr Todd improved from 4 to 3 off and in so doing placed pressure on Mr Johnson who was forced onto Mr Minty who was racing ½ a length back on Mr Johnson’s inner. As a consequence Mr Minty had to check out. Mr Todd was noted to have looked prior to moving.

Mr Todd agreed with this account, saying they were “walking”, and he confirmed he had looked and said he had simply not been aware Mr Minty was there. He said when Mr Johnson yelled to give him room he had done so immediately. He accepted this was too late.

It is clear from the videos that Mr Todd is at best ½ to ¾ L clear of Mr Johnson when he came across. The result was predictable in that Mr Johnson was forced inwards and into the line of Mr Minty who had to check.

Mr Ching described the incident as mid to high range. We agree with this although we believe the incident not to be as serious as Mr Bothamley’s breach earlier in the day. We take a 5 day starting point. Mr Todd has a very good record. He is a busy lower North Island and South Island rider and has only one breach of this rule this season on 19 April last when he was suspended for 3 days and fined $250. A one day reduction is appropriate for his record and plea. We suspend Mr Todd from riding at the end of the day up to and including 9 November. This is 1 premier day and 2 “ordinary” racedays. We also fine him the sum of $500 and remind him of his obligation under the Rules of Racing.
