Under Rule 876 (1) Stipendiary Steward Mr Ching, lodged a protest against the 2nd placing of SPRING TIDE on the grounds of interference to the 3rd placed RECONCILE about 150 metres from the finish. The margin between 2nd and 3rd was ½ L. Judges placings were: 3; 11; 10; 7.

The relevant rule is 876(1) which states:

“If a placed horse or its Rider causes interference within the meaning of this Rule 876 to another placed horse, and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
----
Despite calls across the speaker system and Mr Lawson, assistant stipendiary steward, going to the stables in an endeavour to locate Ms King, trainer of SPRING TIDE, she did not attend the protest. After waiting for a period of 5 minutes after first convening (and 12 to 13 minutes after the end of the race), the protest was conducted in her absence with Ms Whittle, the rider of SPRING TIDE being asked to represent the connections of that horse. She expressed her willingness to do so.

Mr Ching had Mr Davidson, stipendiary steward, demonstrate on the videos that SPRING TIDE under a vigorous ride from Ms Whittle moved sharply inwards and came into contact with TAKE A CHANCE, which in turn came into contact with RECONCILE. Ms Mundy, the rider of RECONCILE, was forced to stop riding, check her mount and gather her reins, before again commencing to ride RECONCILE out. Both Mr Ching and Ms Mundy stated she had stopped riding for 4 strides. Ms Whittle alleged it was only one. However, the Committee counted 4 strides during which time Ms Mundy had stopped riding.

Ms Mundy who had come from behind Ms Whittle was pocketed for 4 strides as a consequence of inwards movement from Ms Whittle when she was not clear. Ms Mundy had to stop riding at a significant point in the race, just over 150 metres from the finish. Ms Mundy was just commencing her run when the interference occurred, she lost all momentum and RECONCILE took some time to regain its balance before finishing on solidly. Mr Ching alleged that RECONCILE lost at least ½ a length when held up for 4 strides. We are also of the view that the horse was also slow to find its feet again after the incident, which caused it to lose more ground. Once steadied the horse finished on strongly, gradually taking ground from SPRING TIDE up until the winning post. In the circumstances we are “of the opinion” that but for the interference to RECONCILE by SPRING TIDE, RECONCILE would have finished ahead of SPRING TIDE. We thus exercise our discretion and relegate SPRING TIDE to behind to RECONCILE.
