Mr Ching demonstrated on the video that Mr Johnson relaxed his ride when 3 or 4 strides from the finish when in 5th placing. Mr Johnson stated he did not disagree with Mr Ching’s interpretation of his ride. Mr Johnson ultimately finished in 7th placing a nose and ½ L behind the 5th horse.

Mr Johnson clearly had a reasonable chance of finishing 5th. The stake lost to the connections was potentially $250. Mr Ching has suggested we take this amount as a guide to penalty. Mr Johnson does not disagree. We accept this sum is appropriate. We fine Mr Johnson $250 and remind him of his obligations under the Rules of Racing.
