Mr Ching, stipendiary steward, alleged that approximately 50 metres after the start Mr Khairil, the rider of UNLADYLIKE, moved inwards when insufficiently clear causing interference to LIVING DOLL (J Todd) and GO OTAGO (D Walsh). Mr Khairil admitted the breach.

Mr Ching demonstrated on the videos that after jumping out Mr Khairil had turned his horse's head in and commenced an angled run towards the fence. In so doing he came into contact with LIVING DOLL, giving that horse a bump, and squeezing GO OTAGO for room. He stated that Mr Todd was attempting to maintain his line when the incident happened. Mr Hamilton said on behalf of Mr Khairil that UNLADYLIKE had jumped awkwardly and was probably on 1 rein at the time. We could see no evidence of UNLADYLIKE jumping awkwardly. She appeared to jump satisfactorily and after a stride or 2 Mr Khairil commenced an angled run towards the rail.

This was the first time Mr Khairil had been "in the room". He had had some 50 rides and, whilst having been spoken to advisedly by the stipendiary stewards, he had never received a formal warning. Mr Ching asked for a suspension. Mr Hamilton asked for a fine of $50, stating that it had occurred close to the start. We do not attach any weight to where the incident occurred. The possibility of danger to other riders was no less (and is perhaps greater) for this fact.

We accept Mr Ching's description of the breach as being lower to mid range and take a starting point of 3 days suspension. We give Mr Khairil credit for his ready admission of the breach and his good record. The fact that he has never been before a Judicial Committee is a significant factor in his favour and we trust he will learn from this experience. After some discussion it was unclear as to whether Mr Khairil would be riding on the coast next week. Mr Ching said Mr Khairil had never previously ridden on the coast, while Mr Hamilton said his intention was to do so. Mr Ching was concerned that the suspension not become a Clayton's penalty; there needed to be a deterrent element. With the agreement of both parties, we intend to permit Mr Khairil to ride at Hokitika, the experience may indeed be invaluable to him. Mr Khairil is suspended from riding at the end of racing Friday 16 March up to and including Sunday 18 March. This is the day at Invercargill. He also fined the sum of $150 and reminded of his obligations under the Rules of Racing.
