Mr Kennedy admitted the breach, which we thus find proved. He indicated he did not wish to be present at the hearing of the charge.
Penalty:
Mr Kennedy is fined the sum of $125 and Mr Ray is asked to remind him of his professional obligations.
Charge:
Mr Ray, stipendiary steward, alleged that Mr Kennedy was neglectful in saddling when LIGHT’S UP was presented with the incorrect saddlecloth number.
Facts:
Mr Ray explained that at the plating inspection LIGHT’S UP was found to be wearing the wrong saddlecloth number. Mr Kennedy had had 3 runners in the previous race and had relied on the jockey to obtain the correct number. This the jockey had failed to do. Mr Kennedy accepted he should have double-checked but did not do so due to time constraints.

Mr Ray stated that the respondent had a previous breach of this rule but in different circumstances in April 2011. He believed a fine in the range of $100 to $150 was appropriate.
Reasons for Penalty:
We accept Mr Ray’s submission that a small fine is appropriate, although we note it was fortuitous that the error was picked up at the plating inspection. Had the horse reached the track, we would have viewed the breach more seriously.
