Accordingly Paw Patrol (6) is disqualified from the race.

Facts:

Following the running of race 7 the ADMIN EXPRESS MAIDEN 1600 an information was lodged by Mr M Davidson, Stipendiary Steward, alleging that Mr R Jones, the rider of the first placed horse PAW PATROL, was in breach of Rule 648 (3) in that “Mr Jones weighed in at 58.6 (0.9kg light) from the weigh out weight of 59.5kg…”

Rule 648 (3) reads:

If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified from the Race.

Mr Davidson stated Mr Jones had weighed out at the correct weight of 59.5kg but had weighed in light at 58.6kg. This was 0.9kg under the drawn weight. Mr Jones was not at fault as the weight bag had not been added to the saddle in the stable area. He was seeking the disqualification of PAW PATROL.

Mr Jones stated he had weighed out correctly and had given all the gear to the trainer. He had only become aware the weight bag was missing when he weighed in.

Reasons for Decision:

Neither the Stewards nor Mr Jones disputed the facts. Mr Jones weighed out correctly, but unfortunately his lead bag was not attached to his saddle in the stable area. As a result Mr Jones weighted in 0.9kg light.
