Mr Davidson explained that Mr Laking (jockey) had approached Mr Ching (stipendiary steward) prior to Race 1, that he was having difficulty with his weight and would be unable to make his riding weight of 57kgs (being 1kg over). Mr Laking was replaced on his two mounts in Race 2 FEEL THE HEAT and race 6 SANDRINGHAM.
REASONS:
--Mr Davidson explained that Mr Laking (jockey) had approached Mr Ching (stipendiary steward) prior to Race 1, that he was having difficulty with his weight and would be unable to make his riding weight of 57kgs (being 1kg over). Mr Laking was replaced on his two mounts in Race 2 FEEL THE HEAT and race 6 SANDRINGHAM. Mr Laking explained that he was struggling with his weight at the moment.
--Rule 520 (4)(c)
Every rider commits a breach of these rules who: wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at the weight which it is handicapped to carry or such other weight at which he agrees to ride the horse.
Mr Davidson (in submission regarding penalty) stated that Mr Laking had been co-operative and that whilst he had been find $600 under this rule on 27 July 2008, he had not infringed since that date. Mr Davidson said that this was a credit to Mr Laking, given the fact that Mr Laking had a continual struggle with his weight. Mr Davidson suggested that this be treated as a ‘first offence’ and that a fine in the range of $200 - $300 be considered.
--The committee adjourned to consider penalty.
--DECISION:
--The committee decided to fine Mr Laking the sum of $200. In coming to the decision, the committee took into account the comments of Mr Davidson (stipendiary steward), Mr Laking’s co-operation and guilty plea, and Mr Laking’s record.
