The relevant rule is 876(1) which states:

“If a placed horse or its Rider causes interference within the meaning of this Rule 876 to another placed horse, and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Ms Mundy demonstrated on the head-on video that ARISOCRAT came into contact with SAINT ZEDE with SAINT ZEDE receiving a sufficient bump to “lose its backend”. Unfortunately it was impossible to synchronise the head-on and side-on videos, with each time the head-on was stopped at the time of contact, the horses were shown side-on to be past the post. In these circumstances the committee called for oral evidence from the parties. Ms Mundy said the contact was a stride before the line and that this had unbalanced her mount. Ms Wilson, who was attending to the horses on behalf of the trainer Ms Rae, agreed with this. Conversely, Mr Todd, the rider of ARISTOCRAT, was adamant that the contact was on or after the winning post and this was supported by Mrs Gordon.

Mr Davidson, stipendiary steward, was asked to comment.  He said the videos were inconclusive. Mr Ching, stipendiary steward, also commented that when he and Ms Mundy had first seen a synchronised head-on and side-on video, contact had appeared to be a stride or ½ a stride before the winning post.

The video evidence is inconclusive. Ms Mundy’s and Mr Todd’s evidence is at odds. One says contact was a stride or perhaps ½ a stride before the line; the other it was at best on the line. Even on the informant’s “best evidence” it is alleged that the interference was only a stride before the line. We do not believe any loss of momentum would have been such to have led us to form the opinion SAINT ZEDE would have finished ahead of ARISTOCRAT. In these circumstances the protest is dismissed.
