As Mr Lowry has admitted the breach, it is found to be proved.

Penalty:

Mr Lowry has sought a deferment until after racing at Riccarton on Saturday and the Informant has no objection to this.

Mr Lowry’s licence is suspended for 4 days.  This is from the end of racing on 7 November up to and including 13 November 2020.

Facts:

Mr Davidson alleged that in Race 8 Mr Lowry permitted his mount LORD ZACFORD to shift inwards dictating MISS CURIOUS inwards onto DOUGH BOY which was checked near the 1300 metres.

Mr McIntyre demonstrated on the films that Mr Lowry who was in gate 9 had shifted inwards shortly after the start. In so doing, he crowded the horses to his inside and Ms Jonker’s horse, which who was racing on the inside, was checked and briefly touched the rail.

Mr Lowry did not dispute that he had shifted in and in so doing had dictated the running line of the horses to his inside. Mr Lowry said that Ms Jonker’s mount had over-reacted. He said he did take hold and relieve the pressure. He did not hear any yelling from the other jockeys. He acknowledged he was at fault and realised he had failed to look after his “mates” on his inside.

Mr Davidson demonstrated on the side on video that Mr Lowry was not his length and another clear when he shifted in. He acknowledged that Ms Jonker’s horse had over-reacted when it touched the rail. It was only a light touch. He added that Ms Jonker told the Stewards she had been yelling for room.

Submissions for Penalty:

Mr Davidson produced the Respondent’s record, which was excellent with no breaches of this Rule in the past 12 months. He described the breach as being low range.

Mr Lowry stated the breach was at the lower end, he had a good record and had caused minimal interference.

Reasons for Penalty:

The breach is low range. Mr Lowry has shifted inwards shortly after the start and crowded runners to his inside. The obligation on Mr Lowry is to be his length and another clear. He was not. As a consequence, Ms Jonker was placed under pressure and her mount made light contact with the running rail. 

A starting point of 6 days is appropriate. Mr Lowry’s record is excellent. Mr Davidson states Mr Lowry would have had over 200 rides this season without a breach of this Rule. A 2-day credit is appropriate for this and the admission of the breach.
