Mr Bothamley admitted a breach of R 638(1)(d) in that he permitted his mount MUSKET MICK to shift in near the 800 metres when not clear of GROOVE ARMADA (C Argue), who had to be checked. Also affected in this incident was KLASSIC PINS. We thus find the charge proved.

--Mr Neal, stipendiary steward, demonstrated on the videos that at the point of the turn, with some 800 metres to run, Mr Bothamley moved across towards the rail into the line of Mr Argue. Mr Argue had to relieve the pressure on his mount and in so doing he came into contact with Ms Collett, inconveniencing Mr Bullard who was racing on her inner.
--Mr Bothamley is clearly demonstrated on the videos to have looked before moving across. He says he made an error of judgment in that he thought he was clear. He was not his length and another length clear. He was, at best, one length clear.
--Mr Bothamley record is good; one breach of this Rule this season. Mr Davidson described the breach as mid range. We agree. He pointed out that the next 3 South Island days are premier days. Having regard to this fact and Mr Bothamley’s ready admission of the breach, we believe a 3 day South Island suspension is appropriate. Mr Bothamley is suspended from the end of racing today up to and including 14 November.
