Mr Muniandy admitted a breach of R 638(1)(d) in that he permitted his mount DEMY LOVARTO to shift in over the final stages when not clear of KIDULT (K Williams), who was checked. We thus find the charge proved.

Mr Neal, stipendiary steward, demonstrated on the videos that over a distance of some 150 metres Mr Muniandy allowed his mount to shift inwards into the line of Ms Williams. On 2 occasions she had to take hold of her mount and check off Mr Muniandy’s heels.

Mr Anderton pointed out, and Mr Davidson did not disagree, that Mr Muniandy did eventually take corrective action, but this was too late. Ms Williams missed 3rd placing by only a nose.

Mr Muniandy has had 3 breaches of this rule this season over a total of 380 rides. However, he has readily admitted the breach and the stewards say he was open and honest in his dealings with them.

Mr Davidson described the breach as mid range and asked for 4 to 5 days but also said we should consider the fact that the next 3 days in the South Island are premier days.

--

We take a starting point of 4 days and give a 1 day discount in light of the guilty plea and the fact that Mr Muniandy will miss 3 of the only 4 premier days in the South Island this season. Mr Muniandy is suspended from the end of riding today up to and including 14 November.
