Penalty:
Mr Gundowry’s request for a deferment until after 8 March is granted. His Class A Jockey’s licence is suspended from the conclusion of racing 8 March up to and including 23 March 2018. Mr Gundowry was also spoken to advisedly concerning the frequency with which he is breaching the careless riding rule.
Facts:
Following the running of Race 2, the TOBIQUE @CLEARVIEW PARK STUD MAIDEN, an information was filed by Stipendiary Steward, Mr McLaughlin, against, Mr Gundowry, alleging careless riding in that he allowed his mount EGYPTIAN LAD to shift inwards when not clear of DOWRY DUTY (K Williams) near the 300 metres.
Mr N McIntyre, Manager of Stewards, used video coverage to show that nearing the 300 metres, EGYPTIAN LAD, ridden by Mr Gundowry, was racing towards the outside of the track with DOWRY DUTY, ridden by Ms K Williams racing on his inside. He said when the respondent was making his run he allowed his mount to shift in crowding Ms Williams. He pointed out that she had had to take hold of her mount.
We asked Mr McIntyre to freeze the frames. This showed that the respondent was not clear of Ms Williams when he shifted. Mr McIntyre assessed this to be ¾ of a length at best.
Mr Gundowry stated that his horse was running on well. It had changed leg, which led to the horse shifting inwards. He believed the horse to Ms Williams’ inside had also rolled out slightly, which added to her crowding. Mr McLaughlin replied any shift was slight.
Submissions for Penalty:
Mr McLaughlin submitted that in the Stewards’ opinion the breach was mid-range.
The starting point should thus be an 8 to 10 days’ suspension. He produced the respondent’s record, which evidenced 3 previous breaches of this rule: all at Riccarton, on 15 November, 8 December and 10 February.
Mr Gundowry did not disagree with Mr McLaughlin’s submission. Mr Gundowry requested a deferment until after Riccarton on 8 March, as he had commitments at that meeting. Mr McLaughlin had no objection to this.
Reasons for Penalty:
We take a 9 National day starting point for what is clearly a mid-range breach. The respondent has kept pushing his horse out to the line despite the fact it was shifting in and casing interference to Ms Williams who has had to check her mount.
An uplift is necessary for Mr Gundowry’s riding record. We set this at 2 days. After a discount of 1 day for the admission of the breach, the penalty is a 10 National-day suspension.
