Penalty:
Ms Tempelman is suspended from riding after racing on the 10th of June up to and including 21 June. This is 2 South Island days.
Charge:
Mr Davidson alleged that Ms Tempelman allowed her mount WIN ROCK to shift in crowding the room of DRUMHILL who clipped a heel and blundered losing ground near the 850 metres.
Facts:
Mr Davidson demonstrated on the video that the respondent shifted in when not clear and came into the running line of DRUMHILL, which clipped a heel, blundered and lost momentum.
Submissions for Decision:
Ms Tempelman said she did not intend to cross over fully and that WIN ROCK had had a warning as to racing manners at its previous start and was lugging in prior to the incident. Mr Hamilton spoke on behalf of the respondent stating that WIN ROCK had its head to the side and that Ms Tempelman thought she was clear but was not.
Reasons for Decision:
Ms Tempelman admitted the breach.
Submissions for Penalty:
Mr Davidson produced Ms Tempelman’s record, which was clear under this rule this season. He stated the degree of carelessness was low but the consequences were high in that a horse blundered and it could have been worse had the horse fallen. He submitted a suspension of 2 to 3 days was appropriate.
Ms Tempelman accepted that she would be suspended and asked that it be deferred until after racing on the 10th.

We accept that Mr Davidson’s description of the incident is accurate. The breach itself is towards the lower end but there was a clipping of heels as a result of her coming across when she was not clear. DRUMHILL lost ground and Mr Mosley on RUSHINELLA, who was racing behind DRUMHILL, also was briefly inconvenienced. We accept that the respondent is a busy apprentice and that her record is excellent. Giving weight to this, her ready admission of the breach, and her degree of culpability, we make a 3 day reduction from our 5 day starting point.
