As Mr Jogoo has admitted the breach, it is found to be proved.

Penalty:

We suspend Mr Jogoo’s licence for 8 National days. This is from 4 December 2017 up to and including 15 December 2017.

Facts:

Mr Davidson alleged that Mr Jogoo permitted his mount JOHNNY JONES to shift outwards over the concluding stages of race 7, the CENTREPOINT LIQUOR SUPPLIES, when not sufficiently clear of DYNAMIC (Mr Shaikh), which was checked.

Mr Davidson said that approaching the last 100 metres JOHNNY JONES was running adjacent to the running rail. The horse was under a hard ride and it commenced to shift outwards. In so doing, the horse came into the rightful running line of DYNAMIC and its jockey, Mr Shaikh, had to take hold and steady his horse. Mr Jogoo had shifted out some 4 or 5 horse widths.

Mr Davidson said there was some danger to Mr Shaikh as his horse could have clipped heels. He pointed out the respondent had continued to use the whip as his horse was shifting ground.

Mr Jogoo said he was aware he was shifting ground and that another horse was coming fast. However, he was not aware he had come into Mr Shaikh’s running line and there had been no yelling.

Mr Walsh said the movement was obvious but he believed the respondent had stopped using his whip in the last 3 or 4 strides. He queried whether JOHNNY JONES had shifted away from the tents in the middle of the track. He said the interference was right on the line and had not cost DYNAMIC a better placing.

Submissions for Penalty:

Mr Davidson produced the respondent’s record which evidenced 3 suspensions in the past year, one in March and two on the same day in October at Timaru. The suspensions on that day were 2 and 3 days, respectively.

Mr Davidson said Mr Jogoo was a busy rider and that this was a reasonable record. He believed the breach was mid-range. The interference had had no bearing on the outcome of the race, although the consequences would have been worse had a heel been clipped. He believed a 7 to 8 day starting point was appropriate.

Mr Walsh accepted that the breach was mid-range and emphasised the interference was minor.

Reasons for Penalty:

Mr Jogoo has permitted his horse to shift outwards over the concluding stages of race 7. In so doing, he has come into the racing line of Mr Shaikh who has had to check his mount near the 25 metres. Of concern to this Committee is the fact that the respondent has at no time taken corrective action. He has simply continued to ride his horse out to the line.

We believe the breach to be at the top end of mid-range and take a starting point of 9 national days. Mr Jogoo’s record is a neutral factor. He is a busy rider. We give a day’s credit for his admission of the breach.
