Mr Hibberd you?ve admitted a breach of rule 520(4)(c) in that you failed to make the contracted weight for SEA SAINT in race 4 today.



Mr Hibberd you?ve admitted a breach of rule 520(4)(c) in that you failed to make the contracted weight for SEA SAINT in race 4 today. You realised shortly after race 2 that you would not be able to make the weight and contacted both Mr Walker and Mr Clutterbuck, the connections of SEA SAINT immediately. They did not agree to the horse being ridden 1/2 kg over but you believe you would have been 3/4 kg over anyway. Fortunately for the connections and for the punter who had invested on the horse early, a jockey with similar experience, Ms J Cameron, was available and she replaced you on SEA SAINT. Mr Ching has said that you are a jockey who never has a problem with weight and that the policy is now to charge all jockeys who are unable to make the contracted weight, but this particular example of the breach is at the bottom end of the scale. He produced your record which showed nothing under this rule.

Mr Hibberd, you?ve said you?re a 47 year-old jockey who has never previously been charged under this rule. You have no explanation for your weight gain other than you might not have been as careful as you should have been after the busy Riccarton carnival ended. Your weight has slipped away on you. The carded weight was 53.5 and you?ve said you?re usually quite comfortable at this weight. The fact that you immediately contacted Mr Walker and Mr Clutterbuck, your clear record and ready admission are all mitigating factors. We fine you the sum of $200 and note that this is consistent with a number of penalties imposed for a breach of this rule. We remind you of your obligations under the Rules of Racing.
