Mr Davidson alleged that Mr Johnson allowed himself to be engaged for 2 mounts in race 2: TAPINSKY K King; and OUR ELLIEMONZ, A Borthwick.

Mr Davidson alleged that Mr Johnson allowed himself to be engaged for 2 mounts in race 2: TAPINSKY K King; and OUR ELLIEMONZ, A Borthwick.
--Mr Johnson admitted the charge and indicated he did not wish to be present at the hearing. We thus find the charge proved.
--Mr Davidson explained that Mr Johnson’s partner Ms Middlewood had taken the ride on TAPINSKY. He was the regular rider of this horse and for the trainer, Ms King. Mr Davidson stated the matter was complicated by the fact that both horses were late nominations. He also said Mr Borthwick had been able to find an alternative rider and thus the Committee was not required to determine a disputed engagement.
--Mr Johnson’s record with respect to this Rule has been very good in the past 2 seasons and he has readily admitted the breach. However, Mr Borthwick has been put to the trouble of finding a replacement rider at late notice. Balancing these matters, we impose a fine of $200.
