Mr Callaway admitted the charge and it is found proved.

Mr Callaway is suspended from the end of racing on March 5th up to and including the 14th March (7 days).

Facts:

Shifting inwards causing crowding and interference brought Mr Callaway before the Stewards on a careless riding charge in Race 6. Mr Callaway admitted a breach of r 638 (1) (d) in that approaching the 1300 metre mark he allowed his mount GLOSS to shift inwards when not clear of RAY’S IN COMMAND causing that horse to clip heels and blunder. Mr Callaway admitted the charge and appeared at the hearing.

Mr Davidson said Mr Callaway was wider out and had attempted to shift into a trailing position. However, he was never clear of the inside runner and as a result Mr Murray was forced to check RAY’S IN COMMAND and in doing so clipped heels and blundered.

Mr Callaway stated that GLOSS was giving him a difficult ride. He had attempted to keep clear but wasn’t able too. He said the inside runners had kicked up when he was 3/4L clear which had contributed to the incident.

Mr Davidson said this was Mr Callaway’s fourth charge inside 12 months. His latest charge was at Banks Peninsula on the 3rd November (8 days). He had a good record over the busy Xmas period. He said the interference was mid-range.

Mr Callaway sought a deferment as he wanted to ride at Riccarton on the 5th March, and for any suspension to start after that meeting. He had admitted the charge and that the horse was giving him a difficult ride be taken into account.

Reasons for Penalty:

We take a starting point of eight days suspension given the interference was mid-range. Mr Callaway’s previous riding record we see as neutral given his good record through the busiest racing period. He admitted the breach at the outset and we give him credit for that. A seven day suspension is appropriate.
