Mr Lowry admitted the charge and it is found proved.

Facts:

Mr Lowry approached Stewards prior to his ride in Race 4 and advised them that he could not make the weight for his ride on INDEX. Stewards charged Mr Lowry with a breach of r 330 (3) (c), which was admitted.

Mr Davidson stated Mr Lowry could not make the weight of 56.5kg for INDEX in Race 4 and had notified Stewards two races prior. He had been replaced by Miss Comignaghi. He had two rides later in the day which he made the weight for, at 56.5kg and 57kg.

Mr Lowry stated he had tried hard to make the weight but found the final 1/4kg too difficult. He had gone running earlier that day but had some difficulty with heat stroke and was forced to re-hydrate. He said there was no excuse for not making the weight.

Submissions for Penalty:

Mr Davidson said this was Mr Lowry’s fourth breach of the rule having been fined three times for a similar breach in December. His last breach was at Otago on the 26th December where he was fined $300. Stewards were seeking a suspension or a fine of $500.

Mr Lowry said he would prefer a fine as opposed to a suspension.

Reasons for Penalty:

This is Mr Lowry’s fourth charge in three months. We don’t believe a suspension is warranted. We take into account that he made a genuine effort to lose the weight and that he made the correct weight of 56.5kg later in the meeting. A fine is appropriate.
