We declare CRAFTY LOVE to be a non-starter.

We also draw attention to the fact that r 632 refers only to the first 3 placings. This rule pre-dates 1st 4 betting. First 4 bets would obviously be affected were a horse that has finished 4th be found to fall within the ambit of this rule.

Facts:

Mr McLaughlin, Stipendiary Steward, sought a ruling pursuant to r 632 as to whether CRAFTY LOVE was denied a fair start in race 3, the ORC LIFE MEMBERS RATING 65 1200M.

Rule 632 states:

If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Mr McLaughlin demonstrated on 2 video angles that when the gates opened CRAFTY LOVE, which was in barrier one, was being held by the bridle by a starter’s attendant. The horse jumped some 2 or 3 lengths behind the field and did not finish in any of the first 4 placings. Mr McLaughlin emphasised that CRAFTY LOVE had led or had raced handy in its 3 previous starts.

Ms Wynne confirmed she had asked the starter’s assistant for help by rubbing the horse’s neck. He did this and the horse’s head started rocking backwards and forwards so the attendant took hold of the bridle. He was still holding the bridle when the gates were released. She said CRAFTY LOVE was very slow away as a consequence.

Reasons for Decision:

When the gates opened the starter’s assistant, who was positioned between the gate of CRAFTY LOVE and the horse to its outer, still had a firm grip on the bridle of CRAFTY LOVE. The horse’s head can be seen to be on an acute angle and was clearly being firmly held. As a consequence when the horse jumped, it was 2 or 3 lengths behind the rest of the field.

We are satisfied that CRAFTY LOVE was denied a fair start through no fault on the part of the horse and that its chances were materially affected.
