Mr Davidson alleged that Mr M Daly presented STORMY RAIN to race with the girth being connected to the off-side stirrup leather.
Facts:
Mr Davidson explained that Mr Daly had 2 horses in the race and had saddled one and had relied on an experienced stable-hand to saddle the other, STORMY RAIN. Because of a delay as a result of a presentation in the previous race, he had not had the time to double-check the saddling, as was his usual practice. Mr Davidson stated the fact that the girth was not connected to the saddle had been detected as the horse went to the start and was remedied before the horse raced.
Submissions for Penalty:
Mr Davidson produced the defendant’s record, which was excellent under this rule, and submitted a fine in the range of $100 to $200 was appropriate.
Reasons for Penalty:
We understand previous breaches of this rule relate to weight issues in saddling and thus we do not find them to be a helpful guide. We believe that there is a safety issue involved with this particular breach and, taking into account the defendant’s admission and his very good record, we believe a fine at the top of the range suggested by Mr Davidson is appropriate.
