The Committee has to be satisfied that the interference is such that it warrants a change of placings. We are not of the opinion that the interference has cost RIO TENNILLE 1st placing and thus we do not exercise our discretion to change the placings.
The protest is dismissed. The official placings stand. Stakes and dividends are to be paid accordingly.

Facts:

Following the running of race 2, the DUNEDIN HOLIDAY PARK 1200, the connections of RIO TENNILLE lodged a protest under r 642(1) against OLYMPIA alleging interference in the final straight.

The official placings were:
1st - 7 OLYMPIA
2nd - 5 RIO TENNILLE
3rd - RD 9 LAY OFF
4th - 2 YES YOU DID

The official margin between 1st and 2nd was a nose.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
(2) For the purposes of Rules 637 and 642:
(a) “placed horse” shall be a horse placed by the Judge in accordance with Rule 641(3); and
(b) “interference” is defined as:
(i) a horse crossing another horse without being at least its own length and one other clear length in front of such other horse at the time of crossing;
(ii) a horse jostling with another horse, unless it is proved that such jostling was caused by the fault of some other horse or Rider or that the horse or Rider jostled with was partly at fault; or
(iii) a horse itself, or its Rider, in any way interfering with another horse or the Rider of another horse in a Race, unless it is proved that such interference was caused by the fault of some other horse or Rider or that the horse or Rider interfered with was partly at fault.”

Submissions for Decision:

Mr Johnson, the rider of RIO TENNILLE, stated that Ms Wynne riding OLYMPIA had shifted ground outwards in the straight and, in so doing had bumped RIO TENNILLE. This was at about the 75 metres mark. He said he had also had to race in restricted room over “the last bit” of the race. He acknowledged his horse had shifted in slightly before the 75 metres but said that the inside horse had “come out to meet him”. When questioned by this Committee, he said he did not stop riding at the time of the initial bump. However, he believed he was not able to get the best out of his horse at the line. He said RIO TENNILLE went up to OLYMPIA, headed it and would have gone on and won the race had there not been interference.

Mr Tapper, the trainer of RIO TENNILLE, supported Mr Johnson’s submissions.

Ms Wynne, the rider of OLYMPIA, agreed that OLYMPIA had come out under pressure. With respect to her initial movement, she said Mr Johnson had also come in. She said she was aware her horse wanted to shift out and had put her whip away in order to keep the horse straight. She believed Mr Johnson was still pushing his horse out at the line.

Mr Ridley, the trainer of OLYMPIA, said RIO TENNILLE had got in front of OLYMPIA briefly and OLYMPIA had fought back. He also acknowledged OLYMPIA had shifted out but he believed Mr Johnson had had every chance to go by his horse if RIO TENNILLE was good enough to do so.

Mr Tidmarsh, Stipendiary Steward, commented on the video and oral evidence. He stated both horses, under pressure, had shifted ground prior to the bump, but more so Ms Wynne. He said the horses had come together over the concluding stages and this Committee had to determine whether the interference was such that we would be of the opinion that RIO TENNILLE would have beaten OLYMPIA had it not occurred. He said the protest had “some merit”. However, he said it did appear Mr Johnson’s riding action had not changed despite there being a bump or two.
 

Reasons for Decision:

RIO TENNILLE has progressed from racing in a position in the field that was behind that of OLYMPIA. It is clear from the videos that OLYMPIA has shifted ground outwards at the time RIO TENNILLE was shifting in, and there was light contact, a bump, with RIO TENNILLE. OLYMPIA has shifted ground to a greater extent than has RIO TENNILLE. Mr Johnson did not allege that RIO TENNILLE had lost momentum as a consequence and he accepted he was able to continue riding his horse. The rear end of RIO TENNILLE can be seen to shift sideways at the time of contact.

Whilst the videos were not conclusive, it appears RIO TENNILLE has briefly headed OLYMPIA, certainly both Mr Johnson and Mr Ridley were of this view. OLYMPIA has fought back over the final 40 or 50 metres and has beaten RIO TENNILLE by a nose. Significantly, Mr Johnson has not had to stop riding RIO TENNILLE and he was pushing RIO TENNILLE out to the line. Despite Ms Wynne putting her whip away close to the winning post, OLYMPIA was still able to out finish RIO TENNILLE in a bobbing finish.
