As Mr Callaway has admitted the breach, it is found proved.
Penalty:
Mr Callaway is suspended from riding after racing 27 May up to and including 2 June. This is 4 national riding days.
Facts:
Mr Davidson alleged that in race 9, the LADIES’ DAY AT WINGATUI ON JUNE 2ND! 1600m, Mr Callaway (OREPUKI LAD) permitted his mount to shift outward near the 300 metres causing COUNTESS RUBY (R Firdhaus) to be placed in restricted room and checked.
Mr McLaughlin, Stipendiary Steward, demonstrated on the videos that on the home turn Mr Callaway was racing in middle of the field when he shifted out into the running line of Mr Firdhaus, who had to check. He said that Mr Callaway was well up inside Mr Firdhaus at the time.
Mr Callaway said that the incident was right on the turn. He was 4 or 5 horse widths out and it was a heavy track. He said his horse had stepped out on the bend as he was pushing the horse forward. The horse was very green and it had not come out a lot. It was an error of judgment on a very heavy track.
Mr Davidson agreed with Mr Callaway that the horse had not moved a lot.

Mr Davidson produced the respondent’s record which was clear this season. He described the respondent as a busy South island rider and this record as “excellent”. He believed it would have been some 18 months to 2 years when Mr Callaway was last on a careless riding charge. He described the breach as low range.
Mr Callaway drew this Committee’s attention to his record and asked that the suspension be as short as the circumstances permitted.
Reasons for Penalty:
We agree the breach is low range. Mr Callaway has not shifted out a lot but he was not clear of the horse to his outside and it was sufficient to bring him into the running line of Mr Firdhaus, who has had to check his mount.
The appropriate starting point is 6 National Riding days. We give a one day discount for the respondent’s very good record and another for his admission of the breach.
We discussed the issue of deferment with Mr Callaway but after consideration he requested that any suspension commence immediately.
