Mr Bothamley admitted the breach and it is found proved.

Penalty:

Mr Bothamley is suspended from 19th May up to and including 27th May 2018 (7 days).

Facts:

Following the running of race 8 the River of Antarctica Maiden, an Information was lodged alleging that Mr D Bothamley was in a breach of r 638(1)(d) in that he “…permitted his mount “Rock Master” to shift inwards when not sufficiently clear of “Chelsea Blue” which had to be checked near the 900 metres causing interference to “Bobtail” and Royal Mistress”.

Rule 638 (1) (d) reads:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless.

Mr Bothamley admitted the breach and appeared at the hearing.

Mr Oatham stated that "Rock Master" was racing about 3 horse widths wide approaching the bend about the 900 metres. He said Mr Bothamley was not a length clear of "Chelsea Blue" (S Muniandy) on his inner when he shifted inwards on the bend. This caused Mr Muniandy to check his mount which set off a chain reaction through the field with subsequent checks to "Bobtail" and "Royal Mistress". He said at the point of the interference the pace had eased slightly and "Chelsea Blue’s" earlier racing manners had been a factor. However, Mr Bothamley had not been the required length clear when he shifted inwards.

Mr Bothamley said he had taken his time coming across from wider out. He said Mr Muniandy’s mount appeared to over race and he thought he was clear of his mount when he shifted inwards.

Submissions for Penalty:

Mr Davidson said Mr Bothamley had a clear record for this rule over the past 12 months. He had admitted the breach and cooperated fully with the stewards and there were some mitigating factors. The level of interference was mid-range and he sought a suspension of 8 days.

Mr Bothamley accepted the submissions of the stewards.

Reasons for Penalty:

Mr Bothamley has an excellent record for breaches of this rule, being his first charge inside 12 months. He admitted the breach at the outset and cooperated fully with the stewards. The level of interference is mid-level, with three runners affected, and we take a starting point of eight days suspension. We give credit for Mr Bothamley’s excellent record, his early admission of the breach and that there were mitigating factors. We reduce the penalty by one day.
