As the breach was admitted the Committee found the charge proved.

Penalty:

Mr Asano is suspended from the 9th of February up to and including Wairoa on the 20th of February (7 days).

Facts:

Mr Asano faces two charges arising out of his ride in race 5.  This second charge relates to an incident in the home straight when Mr Asano allowed his mount EASY ON THE EYE to shift inwards making contact with JUST A GIRL (C Johnson) at about the 175 metres mark.

Mr Oatham stated that Mr Asano was using the whip when EASY ON THE EYE shifted inwards sharply and made heavy contact with JUST A GIRL. He said Mr Asano did not make much effort to straighten his mount until after contact was made. EASY ON THE EYE was racing greenly at the time.

Mr Asano said his mount was hanging inwards and he should not have used the whip. He had straightened his mount too late.

Submissions for Penalty:

Mr Davidson stated Mr Asano’s full record had already been submitted for the first charge. He said this was now Mr Asano’s fourth charge under the careless riding rule in four months. The Stewards viewed the interference as mid-range.

Neither Mr Asano nor Mr Carston made any submissions on penalty.

Reasons for Penalty:

This is Mr Asano’s second breach of the careless riding rule relating to the same race on the same day. We view this incident at mid-range. Mr Asano, who was using the whip on his mount which was hanging, made solid contact with JUST A GIRL who was badly unbalanced. We accept that EASY ON THE EYE was racing greenly and that the respondent took remedial measures, but these were too late. We take a starting point of eight days and give a one day credit for his guilty plea.  We again regard his record as a neutral factor.
