Mr Laking admitted the charge and it is found proved.

Facts:

Mr Laking was charged with a breach of r 330 (3) (c) after declaring he could not make the weight in races 2, 3 and 7 at this meeting. He admitted the breach and appeared at the hearing.

Mr Davidson said Mr Laking approached the Stewards prior to race 1 and advised him he could not make the carded weights for his declared rides on THE SELECTION (R2), SCANDALOUS (R3) and MUSTARD (R7).

Mr Laking stated he had arrived late at the course and attempted to lose the weight in the club’s sauna. However, he was unable to do so. He added it was entirely his fault and he should have had his weight under control before he left from home. 

Submissions for Penalty:

Mr Davidson said Mr Laking had two prior breaches of the rule at South Canterbury on October 11 and Riccarton on November 9th. He had been fined $100 and $200 respectively. But, as this was his third breach the Stewards had lodged an information. He said suitable replacements had been found for the three horses. He sought a fine of $300 to $400.

Mr Laking said he had no excuses for not making the weight and accepted a fine was inevitable. He said he averaged five to six rides per meeting and had been busy over the Xmas and New Year period.

Reasons for Penalty:

We have taken into account Mr Laking is a busy rider and his guilty plea. A fine at the lower end is appropriate.
