As Mr Lowry has admitted the breach it is found to be proved.

Mr Lowry has engagements both days at Blenheim. He is suspended from the end of racing on 26 April up to and including 2 May. This 2 South Island days.
Facts:
Mr Davidson alleged in race 1 THE HITS Rating 65 that Mr Lowry allowed his mount HIGH FORTY to shift in when not clear of VARVARA (Mrs R Tyler) which was checked near the 500 metres.
Mr Davidson had Mr Allison, Stipendiary Steward demonstrate on the video that Mr Lowry was racing one off from the rail. He shifted inwards in a gradual fashion and in so doing Ms Tyler, who was racing to the inside of Mr Lowry, had to check her mount, VARVARA, which lost ground. KEEP THE LOT, which was racing behind VARVARA, was also inconvenienced but to a lesser extent.
Mr Davidson agreed the video angles were not good but confirmed that Mr Lowry was not his length and another clear when he shifted ground. He said Mr Lowry did not appear to go hard to the fence but he had put Mrs Tyler in difficulty for a stride or two.
Mr Anderton said that Mr Lowry had moved ground inwards “marginally” and that Mrs Tyler had checked her mount aggressively when she could have hunted her horse up and perhaps avoided the interference.
Mr Lowry said he accepted he had shifted inwards towards the rail although he had not realised that he had at the time. He heard Mrs Tyler call but it was at the same time as she had checked her mount and it was too late for him to take any action to relieve the pressure on Mrs Tyler. He said he moved gradually towards the fence and had taken a position on the fence sometime after Mrs Tyler had checked her horse.

Mr Davidson said Mr Lowry was a very busy and promising South Island apprentice who was in demand from trainers. He produced Mr Lowry’s record, which showed one previous breach at Ashburton on 11 February last when he was suspended for 2 days. Mr Lowry had had over 150 rides and had 16 winners.
Mr Davidson described the breach as low end and submitted a 2 or 3-day suspension was appropriate.
Mr Anderton reiterated the breach was low end and said he believed a 2-day suspension was sufficient.
Reasons for Penalty:
The breach is low end. Mrs Tyler has had to steady her mount as a consequence of Mr Tyler shifting down on the track when not sufficiently clear. She has lost ground as a consequence and KEEP THE LOT was also inconvenienced slightly.
From a 5 day starting point, a one day’s discount is given for the nature of the breach, and a further 2 days for Mr Lowry's very good record, his admission of the breach and the fact that he is a South Island apprentice.
