FACTS:
Following the running of Race 7, Brent Weatherall Jeweller Rating 70,Information No. 7499 was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Jockey, Miss A M Mundy, alleging a breach of Rule 638 (1) (d) in that, as the rider of BELLONET in the race, she “allowed her mount to shift in dictating SUNSHINE PARK (S Muniandy) inwards onto PRINCESS HALO (K Williams) who was crowded and had to check near the 1000 metres”.
The information was filed after Mr Davidson had obtained the written authority of the Chief Executive of New Zealand Thoroughbred Racing pursuant to Rule 903 (2) (d). That written authority was produced at the hearing of the information, which took place at the meeting of Canterbury Jockey Club at Riccarton Racecourse on Saturday, 6 November 2010.
Miss Mundy was present at the hearing of the information and she indicated that she admitted the breach.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless
SUBMISSION(S):
Mr Davidson had Mr J M McLaughlin, Stipendiary Steward, show head-on and side-on video replays of the start of the race. He pointed out Miss Mundy on BELLONET, which had drawn barrier 12 in the 13-horse field at the 1200 metres start, cross from that barrier after the start and dictate the line of Mr Muniandy, on her inside, and Miss Williams, on his inside, had to check her mount. At no stage was Miss Mundy her own length and another length clear of Mr Muniandy, Mr McLaughlin said.
REASON(S):
The Committee was satisfied that Miss Mundy had ridden carelessly in crossing from an outside barrier draw and dictating the line of Mr Muniandy and causing Miss Williams to check. The Committee noted that Miss Mundy admitted the breach.
DECISION:
The charge was found proved.
SUBMISSION(S) ON PENALTY:
Mr Davidson informed the Committee that Miss Mundy had received a suspension at Riverton on 23 April 2010. That was her only breach of the Rule in the past 12 months. Miss Mundy is one of the South Island’s leading riders, he said. She had admitted the breach. Mr Davidson submitted that the breach was mid-range. Miss Mundy had misjudged her inwards movement and, although she did straighten her mount, she had gone “a stride too far”.
Miss Mundy told the Committee that she had engagements to ride in the Couplands Mile on the second day of the meeting on 10 November and in the New Zealand Cup on the final day, 13 November. She sought a deferment for the seven day period pursuant to Rule 1106 (2).
REASONS:
In determining penalty, the Committee took into account Miss Mundy’s frank admission of the breach and her good riding record. The Committee was aware that Miss Mundy is a busy South Island rider and it is to her credit that she has had only one suspension in the past 12 months – and that was 6 months ago.
The Committee considered that the breach was no higher than mid-range and accepted that it was an error of judgement on Miss Mundy’s part and that, as Mr Davidson stated, she probably went a stride too far before straightening. In all of the circumstances, the Committee was satisfied that a 2-days’ suspension was a sufficient penalty.
PENALTY:
Miss Mundy’s jockey’s licence was suspended for a period commencing after the close of racing on Saturday, 13 November 2010, up to and including Thursday 25 November 2010 – effectively, 2 riding days.
