Decision:

We find the breach proved. 

Penalty:

Ms Black is suspended from riding after racing on 7 February up to and including 22 February. This is 4 South Island days.  

Charge:

Mr Davidson alleged that for about 150 metres Ms Black has continually attempted to force ROBBIE ROOSTER (K Williams) with her mount ASHLEY eventually clipping a heel and blundering. 

Facts:

Mr Davidson demonstrated on the videos that as the horses were turning for home Ms Black was in the trail and for a distance of some 150 metres she endeavoured to force Ms Williams wider on the track, in order to obtain a run. In so doing she eventually got on the heels of a tiring UBETCHA and ASHLEY blundered.  

Submissions for Decision:

Mr Davidson said the respondent’s actions went on far too long and that she had failed to appreciate that ROBBIE ROOSTER was going better than ASHLEY.

Ms Black said that she was trying desperately to get a run and that Ms Williams was stubbornly refusing to let her move out.

Mr Tyler, who assisted the respondent, emphasised that UBETCHA had come back on to ASHLEY rather than Ms Black allowing her horse to run up the heels of UBETCHA. 

Reasons for Decision:

Ms Black admitted the breach.  

Submissions for Penalty:

Mr Davidson submitted the breach was mid-range and that a suspension of 3 to 4 days was appropriate. He said the respondent had “nearly put herself on the deck”. He produced the respondent’s record that showed one previous breach in the past 12 months, although he emphasised she had only been riding for some 6 months of that time.

Ms Black said she wished to ride at Riverton and sought a deferment of the suspension until after this meeting.

Reasons for Penalty:

We are satisfied the respondent’s actions went well beyond competitive riding and that Ms Black was not endeavouring to force Ms Williams out in a safe manner. We are concerned that at the time the respondent clipped heels she was more concerned at looking sideways to see what Ms Williams was up to, rather than noticing that UBETCHA was weakening and coming back onto her. The result was that her horse almost fell.

We are satisfied that the breach is towards the top of mid-range. There were clear safety issues involved. From a 5 day starting point, we give a one day discount for the respondent’s ready admission of the breach and clear remorse. We regard her record as a neutral factor. The penalty is thus 4 days’ suspension.
